These Terms of Service ("Terms") form a binding agreement between you and Glam & Beyond Pro ("we," "us," or "our") regarding your use of the Glam & Beyond Pro mobile application (the "App"). By creating an account or using the App, you agree to be bound by these Terms.
Quick summary: Glam & Beyond Pro is a study aid for the Texas Esthetician licensing exam. We help you prepare, but we do not guarantee you will pass. Your subscription auto-renews until cancelled in your iPhone Settings. We own the app and content; you may use it for personal study only.
1. Acceptance of Terms
By installing, signing up, or using the App, you confirm that:
You are at least 18 years old, or are using the App with verified parental consent.
You have the legal capacity to enter into these Terms.
You have read and understood these Terms and our Privacy Policy.
You agree to use the App only for its intended purpose: personal preparation for esthetician licensing exams.
2. The Service
Glam & Beyond Pro provides:
Practice questions modeled after Texas Department of Licensing and Regulation (TDLR) Esthetician licensing exam content.
Audio narration, AI-generated explanations, mnemonic memory aids, and study progress tracking.
A free 20-question demo with full audio access, and a subscription-based premium tier with full feature access.
⚠ Important: Glam & Beyond Pro is a study aid, not the official Texas state licensing exam. We are not affiliated with the Texas Department of Licensing and Regulation (TDLR), the National-Interstate Council of State Boards of Cosmetology (NIC), Apple, or any official testing body. Our content reflects our best understanding of TDLR regulations and exam topics but may not be exhaustive or current with all rule changes. Always verify rules with the official TDLR rulebook.
3. Account Registration
You must provide accurate information when creating an account.
You are responsible for maintaining the confidentiality of your password.
You are responsible for all activity under your account.
You may not share, sell, or transfer your account.
You may have your account active on up to 3 devices simultaneously. Older devices will be automatically signed out beyond this limit.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions, Billing, and Auto-Renewal
4.1 Subscription Plans
Glam & Beyond Pro offers a free tier (limited questions per session, no AI explanations, no audio, no Final Exams) and a Monthly premium subscription at $14.99/month that unlocks all questions, Final Exams, AI-generated explanations, audio review mode, and progress tracking. Current pricing is always displayed in-app before purchase. Prices may vary by region and may change over time, with reasonable advance notice. We do not currently offer a free trial period; the free tier serves that purpose.
4.2 Automatic Renewal
Recurring subscriptions automatically renew at the end of each subscription period unless cancelled at least 24 hours before the renewal date. Your iTunes/Apple ID account will be charged for renewal within 24 hours of the period ending, at the same price as the previous period.
4.3 How to Manage or Cancel
Open Settings on your iPhone
Tap your name at the top → Subscriptions
Find Glam & Beyond Pro and choose to cancel, change plan, or view renewal date
Cancellation takes effect at the end of the current billing period. You retain access to premium features until that date. We do not have the ability to cancel Apple subscriptions on your behalf — Apple manages all billing.
4.4 Refunds
All payments are processed through Apple. Refund requests are governed by Apple's refund policy:
Apple decides whether to grant the refund. We do not control this process.
By law, EU residents may have additional refund rights under local consumer protection statutes — these are not waived by these Terms.
4.5 Promotional and Offer Codes
We may occasionally offer promotional or offer codes redeemable through Apple's in-app code redemption. Terms of any such offer, including duration and eligibility, will be displayed at the time of redemption. Unless stated otherwise, a redeemed offer converts to the standard Monthly price at the end of the offer period unless cancelled beforehand.
5. Permitted and Prohibited Use
5.1 You may
Use the App for personal study and exam preparation.
Take screenshots for personal note-taking.
Cancel your subscription at any time.
5.2 You may NOT
Copy, reproduce, distribute, sell, or sublicense the App's content (questions, audio, explanations) for any commercial purpose.
Reverse-engineer, decompile, or attempt to extract source code or audio files.
Share your account credentials or use someone else's account.
Use automated tools (bots, scrapers) to access or collect content.
Use the App in any way that violates law, including reproducing testing materials in violation of TDLR or NIC test security rules.
Submit fraudulent payment information.
Attempt to disrupt or compromise the App's security, infrastructure, or other users' accounts.
6. Intellectual Property
The App, including all software code, design, audio narration, AI-generated explanations, question wording, layout, branding, and the "Glam & Beyond Pro" name and logo, is the exclusive property of Glam & Beyond Pro and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal study only, for the duration of your active subscription or use of the free tier. This license terminates automatically when your account is closed or these Terms are violated.
Underlying facts, regulations, and concepts (e.g., TDLR rules, anatomical terminology) are not owned by us and remain in the public domain.
7. Disclaimers
No guarantee of exam results
Glam & Beyond Pro is a study aid. Use of the App does not guarantee that you will pass the Texas Esthetician licensing exam, any other licensing exam, or any other test. Your success depends on many factors outside our control, including your study habits, test-day performance, and the specific content of your exam.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including:
Implied warranties of merchantability or fitness for a particular purpose.
Warranties of accuracy, completeness, or reliability of content.
Warranties of uninterrupted or error-free operation.
Content reflects our best understanding of esthetician topics and TDLR rules at the time of authoring, but rules change and we may not always be current. Always verify regulatory questions against the official TDLR rulebook before applying them in practice.
The App is not a substitute for accredited esthetician education, hands-on practice, or guidance from a licensed instructor. It is a supplemental study tool only.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
Glam & Beyond Pro, its officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
This includes, without limitation, damages for: failure to pass an exam, loss of professional opportunity, lost income, lost data, loss of goodwill, or any other intangible loss.
Our total aggregate liability for any claim arising out of these Terms or the App is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
Some jurisdictions do not allow exclusion of certain warranties or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Glam & Beyond Pro, its affiliates, and their respective officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising from:
Your violation of these Terms.
Your violation of any law or third-party right.
Your misuse of the App.
10. Termination
You may stop using the App at any time. To delete your account and personal data, use the Settings → Delete Account option in the App.
We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or use the App in a way we reasonably believe is harmful, fraudulent, or unlawful.
Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes:
We will update the "Last Updated" date at the top.
We will notify you in the App and/or via email at least 30 days before the change takes effect.
Continued use of the App after the effective date constitutes acceptance of the updated Terms.
If you do not agree to the changes, you may delete your account before the effective date.
12. Governing Law and Dispute Resolution
12.1 Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law principles. International users agree to submit to Texas law for all disputes.
12.2 Informal resolution first
Before bringing a formal dispute, you agree to first contact us at tvandang@gmail.com with a description of the issue. We will work in good faith to resolve disputes informally for at least 30 days before any formal proceeding.
12.3 Dispute resolution
If informal resolution fails, disputes will be resolved by binding individual arbitration in accordance with the rules of the American Arbitration Association ("AAA"). Arbitration will take place in Texas, USA, in English. The arbitrator's decision is final.
You waive the right to participate in class actions against Glam & Beyond Pro. Disputes must be brought individually.
Either party may bring small claims in a Texas small claims court without arbitration if the dispute qualifies under that court's jurisdiction.
13. Apple-Specific Terms
Because Glam & Beyond Pro is distributed through the Apple App Store, the following additional terms apply:
These Terms are between you and Glam & Beyond Pro, not between you and Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
Apple is a third-party beneficiary of these Terms and may enforce them against you.
14. Miscellaneous
Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and Glam & Beyond Pro regarding the App.
Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
No waiver: failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment: you may not transfer your rights under these Terms. We may assign our rights to a successor (e.g., in a business transfer) with reasonable notice.
